Looks like FedEx is the first major company to file a lawsuit against the US government, over refunds. The problem is, this is going to be very messy. As FedEx did pass the cost onto the consumer. Which means, they / FedEx will unlikely pay the money back (the consumer). So this will end up costing the consumer even more.

Problem is, the Supreme court didn't address this, it might be up to a lower court to address this, then challenged again. But if FedEx is the first major company to demand Tariff money back, it will open the floodgates for more.

In this case, there going to be no happy ending here.

The President of the United States may invoke emergency powers in response to an election emergency involving foreign interference, provided certain statutory and procedural requirements are met. The authority to do so primarily derives from the National Emergencies Act (NEA) and the International Emergency Economic Powers Act (IEEPA).

Under the NEA, the President is authorized to declare a national emergency if an extraordinary situation arises that necessitates the use of special or extraordinary powers conferred by Congress. Such a declaration must be transmitted to Congress and published in the Federal Register. 50 USCS § 1621, 50 USCS § 1631. The NEA also requires the President to specify the statutory provisions under which emergency powers will be exercised, either in the declaration itself or through subsequent executive orders. 50 USCS § 1631.

The IEEPA further grants the President authority to address “unusual and extraordinary threats” originating outside the United States that impact national security, foreign policy, or the economy. This authority includes the ability to regulate or prohibit transactions involving foreign property or interests, provided the President has declared a national emergency under the NEA. 50 USCS § 1702, 50 USCS § 1701, United States v. Anvari-Hamedani, 378 F. Supp. 2d 821 (2005). For example, Executive Order 13848, issued under the IEEPA and NEA, declared a national emergency to address foreign interference in U.S. elections, citing such interference as an extraordinary threat to national security and foreign policy . Appendix A to Part 579— Executive Order 13848, EO 14024 Executive Order 14024 of April 15, 2021 Blocking Property With Respect To Specified Harmful Foreign Activities of the Government of the Russian Federation.

Judicial precedent also underscores the constitutional limitations on the President’s emergency powers. In, Youngstown Sheet & Tube Co. v. Sawyer, 343 U.S. 579 (1952). [T]he Supreme Court held that the President does not possess inherent emergency powers absent statutory authorization, emphasizing the need for congressional approval to exercise extraordinary authority. 50 USCS § 1622.

In conclusion, the President may utilize emergency powers to address foreign interference in elections, provided the requirements of the NEA and IEEPA are satisfied, and the actions taken fall within the scope of statutory authority. These powers are subject to procedural safeguards and judicial review to ensure compliance with constitutional and statutory limits.
hopefully this will get shutdown. But if Trump declares an emergency, then America can kiss the midterms goodbye. Still, they would have to prove that china did interfere. But I don;t see that happening. But it just shows how desperate Trump is to control the midterms any way possible.

There's real debate as to whether the Federal government has the slighest authority over the midterms in the first place, given that they're administered by the states.

I think he's just looking for a way of ignoring the result if (when) it's not what he wants. "The result is invalid, they wouldn't let me fix the foreign interference problem."

...Trump installed tarifs - and no one in the US state apparatus knew beforehand that he isn't allowed to do that?
...Trump ordered an attack on Iran - and no one in the US military knew beforehand that the congress need to decide that?

Is this some secret knowledge or is there no mentoring for new staff once a new regime took over...? At least the military should be aware of what they are allowed to do. Right? Maybe it's time that the US not only has the nuclear suitcase but also a war declaration suitcase...

its not that simple. the military isn't ordered to go to war. they're ordered to carry out specific tasks. now the ones issuing those orders, IE the orange one and dude bro, know full well they're committing acts of war without congressional approval. in this instance, they're the only ones that can be held responsible for the broader actions of the military. Note, I'm not talking about specifics like targeting civilians and other war crimes.

I see. Surely some of the higher ranks involved went to some kind of advanced [military] school to learn about basic public international law..? Or are those ranks handed out for doing the most pushups? ...or is the US military that jaded that being on foreign soil & firing weapons isn't counted as an act of war anymore? (let alone bombarding leaders of a country...)

American companies are about to have a big payday, as a court rules against a refund delay when it comes to the illegal tariffs. Customers who most likely paid increased prices on at least some of the items will fund the payout with their taxpayer money. Great success!

New reports about Trump's health, there is a visible rash on Trump's neck,

From the WH, they are claiming, that Trump is getting some common cream, and this is the side effect. But, from other experts that have commented, it could be pre cancer condition or Syphilis. But again, the WH isn't telling the public the truth about his health. Also, he has been seen with this rash, far longer then what the WH has said. As they originally tried to cover this up, and claim it's not a big deal.

So, we have a sick, and mentally gone man, who is burning things down, so he can rule over the ashes.

OH yes, I think this is the side that the so called assassin suppose to hit, notice there is no scar or damage. So, clearly that was fake.

Trump is saying that America will cut off all trade with the nation of Spain, after Spain refused to allow the American army to use its basis to attack Iran. America currently exports goods worth around $27 billion to Spain and imports goods worth $20 billion. Spain is in the EU so it is questionable how a complete trade embargo from America would even work.
