There's a lot more nuance than the tech can't be banned, but the implementation can. There will be a lot of legal challenges to this technology going forward. Who owns the the chatgpt generated output? What happens with the training data uses copyrighted material or isn't agreed to by the person. Should it belong to the underlying individuals that created the data that was used to train the algorithms.

Expect to see a LOT of legal wrangling over these issues in the next few years. Especially as the creators of these tools start charge subscriptions or fees to use a product that could be interpreted as stealing copyrighted materials. And somehow I doubt that the companies creating these tools can provide an exhaustive list of training materials to prove that none are copyrighted.

Bringing it back to Egosoft. This is high risk for a small company. I.e. investing time into how to use this tech in the possible eventually they will have to remove it versus doing more of what they do best.

This is governed by the licenses. Chat GPT is a commercial product, so its user agreement dictates who owns what. There's also Fair Use, search engines rely on Fair Use to be able to show content from other websites without claiming ownership. Though it would be nice if Chat GPT would mention its sources when it spews out facts.

The training materials can be copyrighted, there's still a strong case for it being Fair Use.

Nah, Egosoft could fork OpenChatKit today and start working on their game-specific implementation without having to worry about any legal issues. Since they own the copyright and trademark on everything X-Universe, they can use it as they like. if they should, that's a whole different matter. Since it's a small company, I think the best bet is to wait and see how the technology progresses, and if more tools become available for creating custom implementations. Another option is to train a chat-AI and have it generate X-Universe-specific stories, and have their writer use that as a source of inspiration.
